Valerie McGilvrey Talks Interstate Recorded Telephone Conference Court Hearings

Occasionally I read an argument that is presented with such great magnitude that I stop and question everything that I know to be true. Today, recording telephone conversations is that very thing that posed a question. Not just your everyday run-of-the-mill phone call recording mind you, an interstate recording of a conference call of a court hearing where I was the defendant, sworn in under oath, and was dismissed before my attorney even had a chance to present my defense.

I’m a native Texan and I know that I am legally allowed to record all my calls while my butt…

Valerie McGilvrey Talks About SHAKEN/STIR STIR/SHAKEN

SHAKEN/STIR Shakes Up Robodialers

Why this is GOOD NEWS for skip tracing.

December 30, 2019, was the day that Congress finally stood up for the American people and enacted the TRACED Act (Telephone Robocall Abuse Criminal Enforcement and Deterrence Act). SHAKEN/STIR is another set of acronyms that stands for Signature-based Handling of Asserted Information Using toKENs/Secure Telephone Identity Revisited, and is the tech behind making this beautiful thing work. SHAKEN/STIR is directed at the misuse of robo-dialers to commit fraud against unsuspecting phone owners.

The act gives the deadline of June 30, 2021, for telcos to be in full compliance…

Valerie McGilvrey Talks Voting Machine Memories

In 2018, I attended the Defcon conference in Las Vegas. When my friends and I walked down a hallway in Caesars Palace, there were meeting rooms on each side that held a village of one type or another (classroom that focuses on one subject), one of the fellows pointed out Voting Village.

It may have been the first time Defcon had a Voting Village. I could be wrong about that, but electronic voting machines were still very new in the world of elections. …

Facebook has evolved yet again into a restrictive tank taking the privacy of its users as a priority after a series of congressional hearings that targeted the misuse of data belonging to users. Only one, maybe two details that I wrote about in this article are still relevant. We can no longer search by a phone number. Instead, we must use information from a reference sheet or associates provided on a professional database search. …

Repossessions and the FDCPA

Over thirty years ago, Congress gave the citizens of the United States the Fair Debt Collection Practices Act, most commonly is referred to as the FDCPA. While the law is specifically directed to third party debt collection agencies, individual states may have finance law that goes beyond third-party collection agencies to govern in-house, first-party debt collection efforts.

The usual mechanics of collection and repossession agencies are to take many accounts on contingency. Certainly, that was the case when the federal government first took notice of consumer abuses and congress created the FDCPA in 1978. Agencies went overboard with harassment, scare…

The first reason to request a credit report is obvious; looking for the golden egg. A new address, phone number, or place of employment. I just need one out of three and I can get a little further down the road towards getting a repossession on the hook and ultimately a nice paycheck.

I don’t always pull credit when I get a new assignment. I assume that if I have a good phone number that I can use my wit to sweet talk a debtor. The point is that I fail in determining when I should give it up and…

Once upon a time in a land very close to where you’re sitting right now, there was a sleazy snake oil salesman with a sparkling smile who told me that he had a wonderful device that would allow me to see inside of locked garages. I glared at him and said, “Why, that’s wonderful. I do think I already have this thing you’re trying to sell me for $3999.99. It’s called a borescope and I paid $99.00 for it at Home Depot.” Now you can get one for $10 on eBay.

Innovative smartphone apps have given field investigators and repossessors…

TLO fails to update major changes.

The TLO That Stings

TLO and Delvepoint are both offering Vehicle Sightings and Motorola has bought Vigilant Solutions which operates DRN, MVTrac, and PlaceLocate. Those databases are said to have already merged making this the most robust LPR data source available.

You should wait to sign your new TLO contract. At least wait until after January 1, 2019, when Digital Recognition Network is rumored to end TLOxp’s access to their data which powers the Vehicle Sightings search. A move that TLO has declined to acknowledge, or at least they haven’t informed their sales staff of the contractual split.

If you’ve…

[Update 2/10/2016: Edens was sentenced to one year in federal prison and three years probation after release. He has been serving the remainder of his sentence for stalking and harassment in a Georgia Department of Corrections Prison. He’ll begin his federal prison sentence once his current sentence is completed.]

We’ve all made mistakes. I’ve probably made more mistakes than you have and I’m like any other person who’ll sheepishly look down in shame to reluctantly admit guilt. It’s easier for me to auto-correct as I get older though (thanks to five hours per year of mandatory ethics classes).
